These terms apply to the services Top Hat Media ("we", "us") provides to you. By accepting a quote or paying an invoice, you agree to them. Anything specific in your written quote takes priority over these general terms.
Free mockups and quotes
Mockups and quotes are free and there's no obligation to go ahead. Quotes are valid for 30 days. The mockup design stays ours until you engage us to build the website.
Prices and payment
Our prices are fixed and shown on our website. Clients in Australia are charged in Australian dollars and clients in the United Kingdom in pounds sterling. Payment terms, including any deposit, are set out in your quote. Monthly services are billed in advance each month.
Website builds
Website prices cover the number of pages and features listed for each package. We'll agree the pages, content and timeline with you before we start. Changes outside the agreed scope will be quoted separately before we do them.
Hosting & Care
Hosting & Care is $29 a month and includes hosting, an SSL certificate, daily backups, WordPress and plugin updates and up to 30 minutes of website changes each month. Unused minutes don't carry over to the next month. Hosting & Care is month to month and you can cancel with 30 days' notice.
The 3-year hosting bundle
With the bundle, you prepay 36 months of Hosting & Care ($1,044) and we build a website of up to 15 pages for $50. Because the website discount depends on the full term, the prepaid amount is not refundable if you leave early. After three years you can continue at the monthly price or move your website elsewhere.
SEO
SEO has a 3-month minimum term and then continues month to month until you cancel with 30 days' notice. SEO results depend on many things outside our control, including search engine changes and competition, so we can't guarantee specific rankings or traffic.
Your content
You're responsible for making sure you have the right to use the text, images and logos you give us. We'll use licensed or original material for anything we supply.
Who owns the website
Once you've paid for your build in full, the website is yours. If you decide to move to another host, we'll help you transfer it.
Third-party services
Some features rely on third-party services, such as domain registrars, plugins and payment providers. Their own terms apply and we're not responsible for outages or changes on their side.
Liability
To the extent the law allows, our total liability for any claim is limited to the amount you paid us for the service in the three months before the claim. Nothing in these terms excludes rights you have under the Australian Consumer Law.
Governing law
These terms are governed by the laws of New South Wales, Australia.
